A creditor must file a fresh civil action in a Thai court on the underlying claim, using the foreign judgment as evidence. A foreign arbitral award, by contrast, can be enforced by petition to a Thai court within three years if it falls under the New York Convention.

This guide is for foreign creditors, in-house counsel and overseas law firms whose judgment debtor holds land, shares, bank accounts or receivables in Thailand. It explains why direct enforcement is unavailable, which routes work, and what to prepare before instructing Thai counsel.

1. Why a foreign judgment is not enforceable in Thailand

Thai execution officers act only on a Thai court judgment or order. Thailand has no domestic statute providing for the registration or recognition of foreign civil and commercial judgments, and it is not party to any treaty on the reciprocal enforcement of judgments.

This is a practical point foreign counsel often underestimates. Even a final and conclusive Singapore judgment must be converted into a Thai judgment before Thai assets can be seized. Local reciprocity statutes in the judgment country do not change the position in Thailand.

That does not make the foreign judgment worthless. The judgment, the pleadings and the evidence in the foreign proceedings remain valuable proof in the Thai action.

2. Route 1: a new action in the Thai courts

The creditor sues on the original cause of action — a sale contract, a services agreement, a loan or a guarantee — and relies on the foreign judgment and supporting documents as evidence.

Which Thai court

Civil disputes over international sales of goods, international services, international financial instruments, letters of credit and cross-border remittances fall within the jurisdiction of the Intellectual Property and International Trade Court. Other claims proceed in the ordinary civil or provincial courts, generally where the defendant is domiciled or where the cause of action arose.

A foreign jurisdiction clause does not always block a Thai action. Where a loan agreement named the Singapore courts but did not make them exclusive, the Thai Supreme Court held that the lenders could sue Bangkok-domiciled borrowers in the Central IP&IT Court [: Supreme Court Judgment No. 3537/2546 (2003)]. The exact wording of the clause matters.

How Thai courts treat the foreign judgment

A Thai court is not bound to follow the foreign court. It examines the facts, the applicable law and the defendant’s defences under Thai procedure. A judgment from a court with proper jurisdiction, where the defendant had a fair opportunity to be heard, is typically persuasive on the facts and the amount owed, but its weight depends on the evidence in each case.

If a party argues that foreign law governs the contract, that party must prove the foreign law to the court’s satisfaction, usually through expert evidence. Otherwise the Thai court applies Thai law.

Parallel proceedings are possible. In one case a creditor obtained judgments in both the English High Court and the Thai courts on the same debt, for different amounts; the Supreme Court refused to stay execution of the Thai judgment on that ground alone [ Supreme Court Judgment No. 10839/2558 (2015)]. Creditors should keep an exact record of sums recovered in each country.

Foreign-currency claims

A claim denominated in US dollars or another foreign currency may be pursued in that currency. The debtor may pay in Thai baht at the exchange rate at the place and time of payment.

3. Freezing assets before judgment

The biggest commercial risk is dissipation of assets while the Thai case is pending. Together with the complaint, or at any time before judgment, the plaintiff may apply ex parte for interim measures, including:

attachment or seizure of the defendant’s assets, including sums owed to the defendant by third parties;

a temporary order prohibiting transfer, sale or disposal of assets;

an order directing a registrar to suspend registrations concerning the defendant’s property.

The court grants these orders only on the statutory grounds, so evidence of the debtor’s conduct and a list of identified assets should be ready on the day of filing.

4. Limitation periods

In a new Thai action, the Thai court applies the limitation period of the original claim. The general period is ten years, but many claims carry shorter specific periods, including some trade debts. See also: Limitation Period for Unpaid Invoices in Thailand: Two Years or Five?

Foreign litigation can take years. Creditors should not assume that proceedings abroad interrupt the Thai limitation period; we have not located a Supreme Court decision addressing that question directly. If the original claim is approaching its limitation date, take Thai advice promptly.

5. Route 2: enforcing a foreign arbitral award

A foreign arbitral award is enforceable in Thailand if it falls under a treaty or convention to which Thailand is party, and only to the extent Thailand has agreed to be bound. Thailand and Singapore are both parties to the 1958 New York Convention.

The procedure in outline:

File a petition with a competent court, such as the Central IP&IT Court or the court where either party is domiciled.

File within three years from the date the award became enforceable.

Produce the original award and arbitration agreement, or certified copies, with certified Thai translations.

The court holds an expedited inquiry and renders judgment, after which execution against Thai assets can begin.

The court may refuse enforcement only if the award debtor proves a statutory ground — for example, lack of proper notice of the arbitration, or an award beyond the scope of the submission — or if the dispute is not arbitrable or enforcement would be contrary to public order or good morals.

The Thai Supreme Court has also held that Thai courts cannot set aside an award made abroad; an application to annul must be brought in the courts of the seat [Supreme Court Judgment No. 9476/2558 (2015)].

6. You must sue in a Thai court and use the Singapore judgment as evidence [LAW-00].

Will the Thai court retry the whole case?

The claim must be proven under Thai procedure, but a well-documented foreign judgment can significantly shorten that process. The result depends on the evidence.

Is arbitration a better option for contracts with Thai parties?

Often, where the counterparty’s assets are in Thailand: a New York Convention award can be enforced by petition within three years, usually faster than a new action.

Can I stop the debtor moving assets?

Yes, you may apply for attachment or a non-disposal order with the complaint.

Can I claim in US dollars?

Yes. The debtor may pay in baht at the exchange rate at the time and place of payment.

Conclusion

A foreign judgment is strong evidence in Thailand but not an execution title. Creditors with Thai-based debtors should move quickly to file in a Thai court, check the limitation period and consider an asset freeze. Arbitral awards from New York Convention states offer a shorter route, which is worth weighing when drafting dispute resolution clauses.

Recover Your Foreign Judgment Debt in Thailand with Pattara Law Firm

If you hold a foreign judgment or arbitral award and the debtor has assets in Thailand, timing matters — both for limitation and for the risk that assets are moved. An early review of the judgment, the underlying contract and the debtor’s Thai assets identifies the most practical route.

Pattara Law Firm advises foreign creditors and their overseas counsel on Thai proceedings: document review, limitation and jurisdiction assessment, demand letters and negotiation, filing in the Thai courts with interim-measure applications, award enforcement petitions, and execution against Thai assets. Outcomes depend on the facts and evidence of each matter.

Consult Our Cross-Border Enforcement Lawyers

Telephone: +66 99 249 5989

LINE Official: @patt

WhatsApp: +66 99 249 5989

Email: info@thailandlawyer.com

Short answer: Under Thai law, a judgment from a foreign court — Singapore, England, Hong Kong, China or elsewhere — cannot be registered or executed directly against assets in Thailand.
